1. Introduction and Licensing

Popmolly (“the Platform”, “we”, “us”, or “our”) is an online casino and iGaming service operated under a licence issued by the Government of Curaçao. The Platform provides real-money gambling services including but not limited to online pokies, table games, live dealer games, card games, and other digital wagering products accessible via desktop and mobile devices.

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Popmolly and any individual (“User”, “you”, or “your”) who accesses, registers on, or uses the services offered through the Platform. By creating an account and engaging with any service on the Platform, you confirm that you have read, understood, and unconditionally agreed to these Terms in their entirety.

2. Eligibility and Jurisdictional Restrictions

Any User found to be under the age of eighteen will have their account immediately suspended, all funds will be withheld pending investigation, and the matter may be referred to relevant child protection or regulatory authorities.

2.2 Jurisdictional Restrictions

It is the sole responsibility of each User to ensure that accessing and using the Platform is lawful in their jurisdiction. Popmolly does not accept registrations from individuals located in jurisdictions where online gambling is explicitly prohibited by law. Users residing in restricted territories, including but not limited to the United States of America, the United Kingdom, France, and any other jurisdiction identified on the Platform’s restricted countries list, are prohibited from registering or using any service.

With respect to Australian users, Popmolly acknowledges the regulatory landscape established under the Interactive Gambling Act 2001 (Cth) and its subsequent amendments. Users accessing the Platform from Australia do so at their own legal discretion and accept full personal responsibility for compliance with applicable Australian laws. 2.3 Representation and Warranty

3. Account Registration and Rules

Failure to complete KYC verification within the timeframe specified by the Platform will result in the suspension of withdrawal rights and may result in the restriction of gameplay access. Popmolly reserves the right to withhold any funds pending the satisfactory completion of identity verification.

3.3 Account Security

Users are solely responsible for maintaining the confidentiality of their login credentials. Any activity conducted through a User’s account is deemed to have been authorised by the account holder. Popmolly shall not be held liable for any loss or damage arising from unauthorised access to a User’s account resulting from the User’s failure to maintain the security of their login information.

Users must notify the Platform immediately upon becoming aware of any unauthorised access to or use of their account. Popmolly reserves the right to suspend any account pending investigation of suspected security breaches.

3.4 Accuracy of Registration Information

Users must provide accurate, complete, and truthful information at the time of registration and must update their account details promptly in the event of any changes. Providing false or misleading information constitutes a serious breach of these Terms and may result in immediate account closure and forfeiture of any funds held in the account.

4. Deposits and Withdrawals

4.1 Deposits

Users may fund their accounts using the payment methods made available on the Platform at the relevant time. All deposits must originate from a payment source that is legally owned by the registered account holder. Third-party deposits are strictly prohibited. Popmolly reserves the right to refuse any deposit at its sole discretion and without obligation to provide a reason.

Where the Platform identifies or suspects that funds deposited or withdrawn may be connected to money laundering, fraud, or other criminal activity, it reserves the right to freeze the relevant account, suspend all transactions, and report the matter to the appropriate regulatory or law enforcement authorities.

Users acknowledge and accept that Popmolly may be required by law to disclose information about their account and transactions to regulatory or law enforcement bodies without prior notice to the User.

5. Bonuses and Promotional Terms

• Attempting to reverse-engineer, copy, or reproduce any aspect of the Platform’s software or content
• Harassing, threatening, or abusing other users or Platform staff
• Accessing the Platform from a restricted jurisdiction using a virtual private network or other circumvention technology

Popmolly reserves the right to investigate any suspected breach of this section and to take all appropriate legal and operational action in response.

7. Fair Play and Game Integrity

All games offered on the Platform utilise certified Random Number Generator technology to ensure fair and unbiased outcomes. Game outcomes are independently verified and audited by accredited testing laboratories. Popmolly does not manipulate game results and is committed to providing a fair gaming environment for all users.

Any User found to be attempting to manipulate game outcomes, interfere with the Platform’s systems, or undermine the integrity of any game will have their account immediately suspended and all associated winnings forfeited.

8. Responsible Gambling

Popmolly is committed to promoting responsible gambling and protecting vulnerable users. The Platform offers a range of self-management tools including deposit limits, loss limits, session time limits, self-exclusion options, and cooling-off periods. Users are encouraged to make use of these tools to manage their gambling activity responsibly.

Users who believe they may have a gambling problem are strongly encouraged to seek support from independent organisations that provide counselling and assistance to individuals affected by problem gambling. Popmolly will cooperate with any self-exclusion or exclusion request submitted by a User or a third party acting on their behalf.

The Platform complies with responsible gambling obligations applicable under its licensing conditions and maintains internal policies to identify and assist at-risk users.

9. Fraud Prevention and Security Monitoring

Popmolly employs continuous monitoring of all user accounts and transactions to detect and prevent fraud, money laundering, and other forms of financial crime. Where suspicious activity is identified, the Platform may place a temporary hold on the relevant account and request additional documentation from the User.

Users found to have engaged in fraudulent activity will be permanently banned from the Platform, all funds in the account may be forfeited, and the matter may be referred to relevant law enforcement and regulatory authorities.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Popmolly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from a User’s use of or inability to use the Platform. The Platform’s total liability to any User for any claim arising under these Terms shall not exceed the total amount deposited by that User in the thirty days preceding the claim.

Popmolly does not warrant that the Platform will be available at all times, free from errors or interruptions, or that it will meet the specific requirements of any individual User.

11. Account Suspension and Termination

Popmolly reserves the right to suspend, restrict, or permanently close any User account at its sole discretion, including in circumstances where:

• A User has breached any provision of these Terms
• Suspicious or fraudulent activity has been detected on the account
• The Platform is required to do so under applicable law or regulatory directive
• A User has provided false or misleading information
• The Platform ceases to operate or withdraws its services from a particular jurisdiction

Upon termination of an account, any pending bonuses or promotional credits will be cancelled. Verified funds held in the account at the time of closure will be returned to the User subject to the completion of all applicable verification and compliance checks, unless the funds are subject to forfeiture under these Terms.

12. Dispute Resolution and Complaint Handling

Users who wish to raise a complaint regarding the Platform’s services must first submit a formal complaint through the Platform’s designated support channels. The complaint will be acknowledged within forty-eight hours and a full response will be provided within fourteen business days.

If a User is not satisfied with the outcome of the internal complaint process, they may escalate the matter to the relevant dispute resolution body designated by the Platform’s licensing authority. Popmolly is committed to resolving all disputes in a fair, transparent, and timely manner.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Curaçao. Any dispute arising out of or in connection with these Terms that cannot be resolved through the internal complaint process shall be subject to the exclusive jurisdiction of the competent courts of Curaçao.

Notwithstanding the foregoing, Popmolly acknowledges the consumer protection rights afforded to users under Australian law and does not seek to exclude or limit any rights that cannot lawfully be waived or excluded under applicable Australian legislation.

14. Miscellaneous

These Terms constitute the entire agreement between the User and Popmolly with respect to the use of the Platform and supersede all prior agreements, representations, or understandings. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Popmolly’s failure to enforce any provision of these Terms shall not constitute a waiver of its right to do so in the future. These Terms are binding upon the User and their heirs, successors, and permitted assigns.
